LAHORE – The Lahore High Court on Tuesday rejected the Punjab government’s plea to resign from the stay order granted earlier against the recruitment of 30,000 educators as the officials were unable to answer the court’s and the petitioner’s queries.
Punjab’s Advocate General, Ashtar Ausaf assured the court that the matter will be resolved within a week.
Chief Justice Sheikh Azmat Saeed had on Feb 02 restrained the government from recruiting the educators after a candidate had accused the School Education Department of rigging the recruitment and showing favouritism.
Saqlain Abbas, of Chaniot, had submitted that the Punjab government had invited applications for all subjects as well as Subject Specialist Teachers in BPS-16. The petitioner had pleaded that he had studied Botany and Zoology during his BSc as well as a Masters Degree in Zoology.
The Chiniot District Coordination Officer invited the application through an advertisement for the 615 posts of Educators for Biology/Chemistry and the criteria set was BSc with Chemistry, Zoology and Botany and MSc Biology/Chemistry.
Meanwhile, the Punjab government issued a letter on Nov 23 2011 stating that candidates having BS (Honours) or four years equal to MSc in the prescribed subjects and BSc with three subjects (Physics, Chemistry, Math, Zoology and Botany) are also eligible for this posts (Biochemistry). He pointed out that the department did not advertise that letter and concealed its facts just to deprive the candidates having pre-medical from their fundamental rights.
He pointed out that after this letter the department recruited pre-engineering for teaching Biochemistry to reward their favourite candidates. He also claimed that hiring a teacher for a subject who had never studied it was discriminatory. Assistant Advocate General Shujaat Ali Khan requested the court to quit the stay as the department had completed the process of recruitment but he failed.
The Chief Justice observed, “Please tell me of a teacher who has no degree in a subject but teaches in that subject?” Disappointed at the department officers, the Chief Justice had summoned Advocate General Ashtar Ausaf to apprise the court.
Ashtar Ausaf appeared and assured the court that the matter will be resolved within a week. The Court accepted his request and put off the hearing till Feb 14.

LAHORE:February 15:The Lahore High Court on Tuesday, accepting Punjab government’s plea, vacated a stay granted earlier against the recruitments of 30,000 Educators throughout Punjab.
Chief Justice Sheikh Azmat Saeed issued the order after the Punjab advocate general told him that the Punjab government had issued a new press advertisement after rectifying the mistakes.
The CJ had on February 02 restrained the government from recruiting 30,000 Educators on a candidate’s petition, who alleged that appointments were being made on the basis of favouritism and nepotism.
On previous hearing, Assistant Advocate General Shujaat Ali Khan had requested the court to vacate the stay as the department had completed the process of recruitments but he also could not convince the court on the anomalies in the process of recruitments.
intra-party polls: The Lahore High Court (LHC) on Tuesday adjourned the hearing till February 16 on a constitution petition challenging the abolishment of a constitutional clause binding political parties to hold intra-party elections.
A Deputy Attorney General told the court that another constitutional amendment was required to make it compulsory for political parties to hold intra-party elections.
Petitioner-lawyer A.K Dogar argued that the removal of the clause through the 18th constitutional amendment was against the spirit of constitution and democratic norms. He added that it would tantamount to promoting dictatorship in political parties.
He argued that political parties had become sub-parties of some influential families of the country. He requested to take action and make mandatory for parties to hold intra-party elections.
Police recruitment: Justice Khalid Mehmood of the Lahore High Court on Tuesday directed the Punjab police to submit till March 6 a complete record of Constables’ recruitments during the year 2010 after hearing arguments on a petition filed by a candidate who allegedly was not called for interview despite having been in the merit list.
The judge was hearing a petition filed by a candidate for Constable, Hafiz Irfan, through his counsel Murid Ali Bhutta, questioning the transparency in recruitments in the police department.
Irfan through his lawyer contended that he took written test for the post of Constable and passed it with flying colours but he was not called for interview instead the candidates who were low in the merit list got calls for interview and were later selected in violation of the merit policy. A Deputy Attorney General, submitting a report in the court on behalf of the police department, said that the petitioner candidate was called for interview but he could not pass it.
Upon this, Justice Mehmood remarked “you’re submitting a report that the candidate failed in interview while the candidate is saying in open court that he was not called for interview. How can he fail in an interview for which he hasn’t been called?” Sensing ambiguity in the matter, the judge passed directions for submitting complete record of Constables’ recruitments during 2010.The news.
